Rules of the game "OPERATION TICKET D'OR - Patinage Magazine - Hockey Magazine 2022 - 2023 ARTICLE 1 - ORGANIZER AND PERIOD OF THE GAME Média Loisirs International Sarl with a share capital of €10,000, registered in the Grenoble Trade and Companies Register under no. 84233126600010, whose head office is located at: 42 chemin de la Patinoire 38250 Villard de Lans (hereinafter referred to as "MLI"), is organising a game with a draw and a purchase obligation, entitled "OPERATION TICKET D'OR Patinage Magazine - Hockey Magazine" (hereinafter referred to as the "Game"). The Game will run from November 3 to november 23, 2022 (inclusive) and may be extended depending on the participation of the first 20 days. Participation in the present Game implies acceptance of the present rules in their entirety and of MLI's decision on any dispute that may arise concerning the interpretation and application of the present rules. ARTICLE 2 - CONDITIONS OF PARTICIPATION 2.1. The Game is open to the following persons: any person of legal age who has purchased, on the KissKissBankBank online site, at least one (1) off-series or a Digital + Print subscription during the Ticket d'Or operation period - from November 3 to november 23, 2022 and during the extension period if there is an extension depending on the remaining prizes (hereinafter the "Participant"). 2.2 MLI reserves the right to ask any Participant to prove these conditions, in particular by presenting the proof of purchase. 2.3 Any incomplete entry, not complying with the conditions set out in these rules, falsified, out of time, or containing inaccurate or false information, will not be taken into consideration and will be considered as void. 2.4. Any Participant who does not meet the conditions indicated in the present rules or who refuses to justify them will be excluded from the Game and will not be able to benefit from the prize in case of winning. MLI also reserves the right to exclude from the Game at any time and without prior notice, any Participant who adopts an unfair attitude with regard to the present Game and its functioning or who, by his fraudulent behavior, in any form whatsoever, would harm the smooth running of the Game. ARTICLE 3: GAME MECHANISM Participation in the Game is as follows: - Six (6) Golden Tickets were slipped into the 4 Hors-series in a limited edition of 2023 copies and each sold on the KissKissBankBank website for the participatory pre-sale campaign, during the period from November 03 to November 23, 2022 (inclusive). Each Participant will have the chance to discover one of these 6 Golden Tickets. The Golden Tickets can be hidden in any Skating Magazine or Hockey Magazine special edition as part of the sale of this operation. - The six (6) Participants in possession of the Golden Tickets (the "Winners") will receive a trip of a maximum value of 2000 euros. ARTICLE 4: PRIZE AND DELIVERY OF THE PRIZE 4.1. The prizes at stake are the following: For the pre-order of the special edition of Skate Magazine 2022 2023 (delivery in June 2022) 1 golden ticket slipped into one of the 2023 copies of the special edition for a trip for two to Montreal from March 18 to 24, 2024 for the World Figure Skating Championships (Value 2000 euros) For the pre-order of the special edition In Olivier's Lens (delivery in April 2022) 1 golden ticket slipped into one of the 2023 copies of the special edition for a trip for two to Montreal from March 18 to 24, 2024 for the World Figure Skating Championships (Value 2000 euros) For the pre-order of the special edition Japan On Ice (delivery in May 2022) 1 golden ticket slipped into one of the 2023 copies of the special edition for a trip for two to Montreal from March 18 to 24, 2024 for the World Figure Skating Championships (value 2000 euros) For the pre-order of the Hors-Série Hockey Magazine 2022 2023 (delivery in June 2022) 1 golden ticket slipped into one of the 2023 copies of the special edition for a trip for two to Prague / Ostrava from May 10 to 26, 2024 for the World Ice Hockey Championships to cheer on the French team. (value 2000 euros) For a subscription (Print + Digital) to Patinage Magazine from N°167 to N° 170 1 golden ticket slipped into one of the 2023 copies of the special edition for a trip for two to Montreal from March 18 to 24, 2024 for the World Figure Skating Championships (value 2000 euros) For a Print & Digital subscription to Hockey Magazine from N° 152 to N° 155 1 golden ticket slipped into one of the 2023 copies of the special edition for a trip for two to Prague / Ostrava from May 10 to 26, 2024 for the World Ice Hockey Championships to cheer on the French team. (value 2000 euros) 4.2. Winners must follow the instructions on the Golden Ticket. 4.3. The prizes are nominative. The deadline for claiming the prize is January 31, 2022 for the two gold tickets in the Skate Magazine and Hockey Magazine subscriptions and August 31 for the 4 gold tickets in the special issues. 4.4. Any consideration returned to MLI by mail or by the service provider in charge of transportation for any reason whatsoever will be considered abandoned by the Winner. 4.5. The prize may not be awarded in any other form than that provided for in these rules. No cash, goods or services will be awarded in exchange for the prizes won. 4.6. MLI reserves the right, if circumstances so require, to substitute, at any time, the prizes with a prize of at least an equivalent value, without any claim being able to be made in this respect. MLI will not be held responsible for this fact. ARTICLE 5 - RESPONSIBILITY 5.1. MLI also declines any responsibility for any error of delivery, deterioration during the transport, loss of the prizes or the impossibility to contact the Winner in case of an erroneous or incomplete address. In this case, the responsibility of the carrier will have to be sought directly by the Winner who will be responsible for it, without recourse against MLI. 5.2. MLI shall not be held responsible for any incident that may occur during the enjoyment of the prizes, except in the case of the application of the legal guarantees, if any. It will not be responsible for the impossibility for a Winner to use his prize. 5.3. In case of exceptional circumstances, MLI reserves the right to interrupt, extend or shorten the Game or to modify the conditions of its organization. MLI shall not be held responsible for this. 5.4. MLI shall not be held responsible for any breakdowns, errors, computer viruses that could prevent the continuity of access to the Game's website or for any malfunctioning of the users' computer system that could be observed following access to the Game's website. MLI shall not be held responsible in case of hacking or any other attack on its computer system, and for the consequences that these may cause to the user. In case of technical malfunction of the Game, MLI reserves the right to cancel the session during which this malfunction took place. ARTICLE 6 - PROTECTION OF PERSONAL DATA 6.1. In order to be able to supervise the dispatch, the routing and the follow-up of the prizes to the Winners, the latter will have to provide certain personal data concerning them to MLI's data controller. The personal data to be provided will be the following: name, first name, postal address, telephone number, e-mail address and will be used for the sole purpose mentioned above. 6.2. These personal data are intended for MLI and its transport provider for the expedition, the routing and the follow-up of the counterparties. They will be recorded and saved in a computer file for a period necessary for the dispatch, the routing and the follow-up of the counterparties, in accordance with the present rules. This personal data will not be used for direct marketing purposes, except with the express, written and prior consent of the Winner. 6.3. You have the right to (i) access your personal data, (ii) request that it be corrected, completed, updated, locked or deleted, and (iii) determine the fate of your personal data after your death and (iv) request that we send you a copy of your personal data in a commonly used and machine-readable format. We will comply with such requests in accordance with applicable law and may also verify your identity for the purpose of processing such requests. 6.4. We do not intend to use your telephone number for cold calling. However, we would like to inform you that any telephone solicitation can now be opposed by you. The reproduction, representation or exploitation of all or part of the elements (graphics, etc.) making up the Game are strictly prohibited. 7.2. The brands, logos, drawings, product names, whether or not they appear in bold type or accompanied by a brand symbol, are likely to be the property of MLI Any exploitation of these elements, whatever the mode, is subject to the respect of the protective rules of the intellectual property. ARTICLE 8 - REIMBURSEMENT The costs inherent to the participation in the Game are entirely at the Participant's expense and he/she shall not be able to claim reimbursement from MLI under any circumstances. ARTICLE 9 - CLAIMS 9.1. Any complaint concerning the Game must be made within one (1) month after the deadline for participation in the Game, by simple letter addressed to MLI at the address indicated in article 1 of these rules. This letter must indicate the precise date of participation in the Game, the full contact details and the exact reason for the complaint. No other method of complaint may be taken into account. 9.2 MLI is the sole judge to decide any question of application or interpretation of the present rules. ARTICLE 10 - ACCEPTANCE OF THE RULES 10.1. Participation to the Game implies the unconditional acceptance of all the present rules. 10.2. No tolerance on the application of the provisions of the rules can be interpreted as a waiver on the part of MLI to take advantage of them later. 10.3 If one or several provisions of the present rules are declared null and void or inapplicable, the other clauses will keep all their force and scope or can be replaced by a new valid provision. ARTICLE 11 - APPLICABLE LAW AND JURISDICTION 11.1. The present rules are governed by French law. 11.2. Any dispute arising in connection with this Game will be subject to an attempt at amicable settlement. In the absence of an agreement, the dispute will be submitted to the competent jurisdictions of MLI's head office, except for public order provisions to the contrary.
